Can I return original art bought online from Brazil?

Perfeito Studio's shipping terms and Acquisition Agreement do not state a return policy for international orders. Brazilian consumer law gives a 7-day right of withdrawal for distance purchases, but whether it reaches a buyer abroad, and who pays return freight, is not set out in those terms. Confirm both with the studio, in writing, before you pay.

What is written down, and what is not

Every acquisition from the studio is made directly from the artist. It includes the original painting, a signed Certificate of Authenticity with the Archive ID, a fiscal invoice or receipt, an Artwork Acquisition Agreement covering transfer of ownership, copyright and image use, an artist dossier, care guidance and professional packaging. The published shipping terms say that shipping is quoted per destination and that the buyer pays freight and any import duties or taxes in the destination country.

None of those documents (the shipping terms and the Agreement template) sets out a return window, a refund procedure or a return-shipping rule for an order that has already crossed a border. The Acquisition Agreement template covers transfer of ownership, copyright and image use, and has no return clause. For anything beyond that, the answer is: confirm with the studio.

What Brazilian consumer law says about distance sales

Article 49 of Brazil's Consumer Defense Code lets a consumer withdraw from a purchase made outside the seller's premises, which includes online sales, within 7 days of signing the contract or receiving the product. No reason is required, and amounts already paid are to be refunded promptly with monetary correction. The Brasília court's public-information service describes the rule in these terms.

That is a statement about Brazilian consumer law. The studio's shipping terms and the Agreement do not say how, or whether, it applies to a buyer resident in another country, and this page cannot settle that. It is not legal advice. If a return right matters to your decision, ask the studio to state in writing how it would handle your case, and consider asking your own adviser.

Questions to put to the studio before you pay

Four points are not covered by the studio's shipping terms or the Agreement, so they are worth settling in writing before payment: the return window that would apply to your destination; who pays return freight and insurance; what happens with import duties or taxes already paid on arrival; and the condition the painting must be in to qualify. The shipping terms only confirm that inbound freight and import duties fall to the buyer.

Reducing the chance you will need a return

For buyers outside Brasília, the studio sends additional detail photographs and video of a specific work on request through WhatsApp. Each painting is also photographed in detail before it leaves the studio. Viewing in person is possible by appointment, since part of the collection is on view at INTI, in Lago Sul, Brasília; it is a working clinic, so visits are arranged in advance. A note from the studio on looking before you buy

Prism Garden is 100 × 100 cm, acrylic on canvas, in the Luminous Rebirth series, and it is built from thin, diluted washes that let the layers underneath show through. A surface like that can read differently on a screen than on a wall, which is why I would rather a buyer ask for close-up photographs and a short video than decide from one image. Trained as an architect, I think about a painting in relation to the wall and the light it will sit in, so questions about scale and colour are welcome before a purchase, not after it.

What condition does the artwork need to be in to qualify for a return?
